Yup.  I believe that`s the way the law works.

I remember many years ago a big story where the cops were called.  When they
got there, the guy was in his car, engine running, driver passed out drunk.

The argument was "why didn`t you do something?" and the cops had to respond
"There was no crime being committed and no one was in danger."  They waited and
tried to wake the guy (which would create the potential of danger), but they
couldn`t.  So they left.

But I can`t count the number of farm kids I knew who had years of driving
experience before they got to driver`s training and could get their learner`s
permit.
